For years, we have counselled resource-based and other businesses, individuals and enterprises operating in Labrador. Our considerable experience includes:

  • Extensive experience with the full range of project development and associated secured transactions including in the areas of mining, property development and hydroelectric projects;
  • Significant experience with Newfoundland and Labrador laws governing Crown lands, surface rights, mineral rights, and the issuance of mineral exploration and mining titles and permits under the Mineral Act and Mining Act;
  • Significant experience with respect to the full range of mining transactional matters including mineral licence and mining lease issuances and transfers, option agreements, joint venture agreements, royalty agreements and mining-related securities law matters;
  • Experience in dealing with the acquisition of permits and titles under the Nunatsiavut Labrador Inuit Lands Act and Exploration and Quarrying Standards Act;
  • Comprehensive experience in all aspects of negotiating and documenting commercial agreements, including as necessary, the acquisition of real property rights and interests governed by Newfoundland and Labrador and Nunatsiavut law;
  • Strong understanding and knowledge of the land claims regime formalized in the Labrador Inuit Lands Claims Agreement Act, and good working knowledge of the Regional Land Use Plan thereunder;
  • Strong understanding, knowledge and awareness of consultation/accommodation obligations in relation to aboriginal title and rights claims asserted by the Labrador Innu and the NunatuKavut, and also by a number of Québec-based aboriginal groups, including the status of relevant land claims negotiations and litigation pertaining to such claims;
  • Negotiation and formalization of project agreements, construction contracts and subcontracts, and employment agreements;
  • Significant expertise in advising on environmental assessment and permitting matters and environmental liabilities under the province’s Mineral Act, Mining Act, Environmental Protection Act and Water Resources Act;
  • Significant experience advising clients regarding environmental matters under the federal Fisheries Act and Canadian Environmental Assessment Act, 2012;
  • Experience defending environmental prosecutions;
  • Experience as strategic advisors to employers navigating the employment-based immigration process to recruit and retain international employees at all skill levels; and
  • Significant experience with the mining and mineral rights tax regime prescribed by the Newfoundland and Labrador Revenue Administration Act;
