: Client Update - CPP Disability Benefits are Deductible from Damages for Income Loss arising from Automobile Accidents

In McKeough v. Miller, 2009 NSSC 394, the Nova Scotia Supreme Court has interpreted sections 113A and 113B of the Nova Scotia Insurance Act to allow the deduction of past and future CPP disability benefits from damages for loss of income arising from automobile accidents that have occurred since November 1, 2003.
