In the November 2013 edition of the International Association of Defense Counsel’s (IADC) Transportation Committee Newsletter — distributed to over 300 committee members in nine countries — Halifax-based co-authors, William Moreira, QC, and Scott Campbell, summarize and highlight the significance of an August 2013 Supreme Court of Canada ruling in the case of a shipboard injury or death.

The ruling in favour of provincial statutes governing workplace injury and compensation (inclusive of their prohibition or private legal action against employers) is an exception to longstanding Canadian constitutional jurisprudence, establishing that Canadian maritime law is exclusively a matter of federal law and generally unaffected by local statues of any of the provinces.

Entitled “Workers’ Compensation Bar of Action Applies in Cases of Personal Injury and Death Governed by Canadian Maritime Law,” the article will also be published in the IADC’s January 2014 Defense Counsel Journal, issued quarterly and accessible to over 3,000 IADC members in 40 countries.
