Halifax-based partner Brian Johnston, QC, answers questions in “Ask an Expert with Brian Johnston” about (1) recovering vacation days taken, but not yet earned by employees who are fired or quit and (2) the potential consequence of filing a harassment complaint at a human rights commission before bringing it up with the employer.

Advice on both: (1) Unionized and non-unionized employers should create agreements providing for recovery on termination at the outset , and (2) employees should report harassment to employers first, unless they want to increase the likelihood of an unfavorable finding by a human rights tribunal or board.
