: Client Update - "New" New Brunswick Limitation of Actions Act

The new New Brunswick Limitation of Actions Act came into force on May 1, 2010.  With the new legislation comes a new set of rules to determine when a claim may be brought.  A specific limitation of two years was formerly provided for claims arising from motor vehicle accidents.  For most automobile insurance matters, the limitation period will not change under the new legislation, as automobile accident claims are caught by the new general limitation period of two years from the date on which the claim is discovered.  There would be few instances where a claim arising from an automobile accident is not discovered on the date of loss.
