Brian Johnston, QC, interviewed for CBC Nova Scotia article on teachers legislation
Labour and employment partner Brian Johnston, QC, was quoted in a recent CBC Nova Scotia article that took a further look at the proposed legislation for teachers in the province.
Although a recent decision from the Supreme Court of Canada (“SCC”) on a similar British Columbia case was thought to help in Nova Scotia, Brian states that may not be the case. “The B.C. Federation of Teachers case didn’t change the law, it was all about the facts,” said Brian. With the SCC now more protective over collective bargaining, Brian believes the provincial government may say, ” … we knew what the high standard was when we introduced our legislation … we negotiated in good faith and we consulted and we went through a process and we didn’t do anything wrong …”
